Bad Faith Registration

Bad faith registration is a key element of [[udrp]] and [[acpa]] claims, referring to the intentional registration or use of a domain name to exploit the goodwill of another party's trademark. ICANN's UDRP policy provides a non-exhaustive list of bad faith indicators, including: registering a domain primarily to sell it to the trademark owner at a profit; a pattern of [[cybersquatting]]; registering to disrupt a competitor's business; or intentionally attracting users for commercial gain by creating likelihood of confusion. Panels also consider whether the [[registrant]] had constructive knowledge of the trademark at the time of registration, and whether the domain has been used in a [[phishing]] scheme or to host pay-per-click advertising targeting the trademark owner's customers.

Example

Registering 'apple-support-helpdesk.com' to host a fake tech support scam page was found to constitute bad faith registration under UDRP, resulting in immediate transfer and referral to law enforcement.
